Terms and Conditions for Spook City - Shirts and More

1. Scope
1.1 These Terms and Conditions (T&Cs) govern all orders placed via the Spook City - Shirts and More online shop (hereinafter "the provider" or "we").
1.2 By using the website or placing an order, the customer agrees to these T&Cs.

2. Contractual Partner

3. Offer and Contract Formation
3.1 All product listings are non-binding. A contract is concluded only after the provider confirms the customer’s order.
3.2 The presentation of items does not constitute a legally binding offer.

4. Condition of Goods and Pricing
4.1 Many of our items, such as records and film media, are pre-owned. Conditions are assessed using recognized standards like the Goldmine Grading Standard and verified sources.
4.2 Prices depend on condition, edition, and market value and may change based on new information.

5. Prices and Shipping Costs
5.1 All prices are final and include VAT.
5.2 Shipping costs are displayed during checkout and added to the total price.

6. Payment Terms
6.1 Payments are processed exclusively via PayPal.
6.2 The total purchase price is due immediately upon order placement.

7. Shipping and Delivery
7.1 Orders within Austria are shipped via the Österreichische Post, while orders to Germany and other countries are shipped from Germany via DHL or Hermes.
7.2 Orders are dispatched only on Mondays. Delivery times may vary.
7.3 Returns:

  • For customers in Austria: Schattbergsiedlung 32, 6370 Kitzbühel, Austria.

  • For customers outside Austria: Ursula Haas, C/O Lukas Schroll, Lärchenstraße 2, 75433 Maulbronn, Germany.

8. Right of Withdrawal
8.1 Consumers are entitled to a 14-day right of withdrawal. Refer to the withdrawal policy for details.

9. Liability
9.1 Statutory warranty rights apply.
9.2 Liability for damages is limited to cases of gross negligence or intentional misconduct.

10. Privacy
The processing of personal data is subject to our Privacy Policy.

11. Final Provisions
11.1 Austrian law governs these terms and any disputes arising from them.
11.2 If any provision of these T&Cs is deemed invalid, the remaining provisions remain enforceable.

"Spook City" is a cooperation between legally independent companies. With regard to customers, suppliers, or other parties in the context of this cooperation, the companies part taking in the cooperation remain legally independent and autonomous entities (each with its own areas of activity, brand presence, etc.), and that separate contractual relationships will be established with each of the business of the cooperation.
